Hypnotically-refreshed testimony of witnesses and victims of crimes
is admissible in Texas courts!
The landmark case on the use of this incredibly effective, but rarely used, investigative
tool is Zani v.
Texas, 767 S.W.2d 825, 835 (Tex. App.- Texarkana 1989, pet. Refʼd.). The Zani case set out very specific rules governing the procedures and the process that must be
followed in cases where hypnosis is used. By following the requirements set forth in
Zani, the integrity of the witness' or victim's testimony is preserved.
Even the United States Supreme Court has ruled on the admissibility of hypnotically-refreshed
recall. For a detailed description of the facts and circumstances of this seminal case, see Rock v. Arkansas, 483 U.S. 44, 107 S. Ct. 2704, 97 L. Ed. 2d 37 (1987).
SB 929 (1987) and TCLEOSE Rule §221.7
In 1987, the Texas Legislature established mandatory training, testing, and certification of
police officers who use hypnotic interviewing techniques. Taking guidance and direction from the bill
passed in 1987, the Texas Commission on Law Enforcement Officer Standards and Education established rules
governing the training, testing, and certification of peace officers as directed by the
Legislature.
TCLEOSE requires a 50-hour Investigative Hypnosis certification course, a state exam, and a
proficiency certificate for officers who wish to use hypnosis in Texas. TCLEOSE established rules that include a
potential $1,000.00 fine for the supervisor or agency administrator of any police officer who uses a Hypnotic
Interviewing Technique and is not certified by the Commission.
Early registration tuition for this course is $550 per officer if paid prior to October 15, 2011.
On or after October 15th, tuition is $675 per officer. Students should register with and make payment
